Background Information:

There is only a minor change to this policy and the change is reflected in law and state board rules and regulations. By law, students receiving special education services cannot be restrained, except as permitted by law (TCA §49-10-1301, et seq. TRR/MS 0520-1-9-.23). The relevant part of the statute (TCA §49-10-1305) and the State Board of Education’s Rule are attached for your reference. The law sets forth prohibitions and the State Board Rule sets forth the procedure if restraint is necessary. Our current policy is attached for informational purposes only.

Staff Recommendation:

I recommend approval of the amendment to Board Policy #6.500 – Special Education Students, as set forth above on first reading.
